1. Introduction & The Platform Role

Raha (“Raha,” “we,” “us,” or “our”) provides a subscription-based digital content marketplace designed for creators in East Africa and worldwide. Raha acts as an intermediary technology provider facilitating connections, content hosting, and payment settlement between content creators (“Creators”) and subscribing fans (“Fans” or “Users”).

By accessing, browsing, registering for, or using Raha, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately discontinue use of the platform.

2. Strict 18+ Age Requirement & Verification

Raha is strictly an adult community platform. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction (whichever is greater), to create an account, browse content, or transact on Raha.

To qualify as a Creator on Raha, applicants must undergo mandatory identity verification by submitting a valid government-issued photo ID (National ID Card, Passport, or Alien Card) alongside a live verification photo/selfie matching the document. Raha reserves the right to re-verify any user or creator at any time.

3. Standard Contract Between Fan and Creator

When a Fan purchases a subscription, tips, or unlocks pay-per-view media from a Creator on Raha, the Fan enters directly into a legally binding contract with that Creator (the “Fan-Creator Agreement”). Raha is not a party to this agreement and acts solely as the technical and billing intermediary.

4. Creator Obligations, Content & Co-Performers

Creators retain 100% ownership and copyright of the original content they upload to Raha. By uploading content, Creators grant Raha a worldwide, non-exclusive, royalty-free license to host, transcode, stream, cache, and display the content solely for the purpose of operating the platform.

Co-Performer & Third-Party Consent: If any media uploaded by a Creator features or depicts another individual, the Creator certifies that:

• Every individual depicted is at least 18 years of age.
• The Creator has obtained full, written, un-coerced consent from all individuals to be recorded and to have their likeness displayed and monetized on Raha.
• The Creator maintains verifiable records of photo identification and signed consent forms and will provide them to Raha or authorized regulators upon request.

5. Prohibited Conduct & Content Guidelines

Users and Creators may not upload, broadcast, publish, or transmit content that:

• Depicts or promotes Child Sexual Abuse Material (CSAM) or exploitation of minors.
• Depicts non-consensual sexual acts, sexual violence, or non-consensual intimate imagery.
• Involves bestiality, extreme violence, self-harm, or suicide incitement.
• Promotes human trafficking, prostitution, or solicitation of in-person commercial sexual services.
• Contains non-consensual AI-generated synthetic media, deepfakes, or impersonation of others.
• Infringes on any third party’s copyright, trademark, privacy, or publicity rights.
• Attempts to distribute malware, phishing links, or unauthorized spam.

6. Payments, M-Pesa Transactions & Creator Payouts

Transactions on Raha are denominated in Kenya Shillings (KES) or supported regional currencies. Raha utilizes Safaricom M-Pesa Daraja STK Push and secure mobile money integrations for wallet deposits, creator tips, and subscription billing.

7. Strict No-Refund Policy & Chargebacks

Due to the digital, immediately consumable nature of online content, all purchases, subscriptions, pay-per-view unlocks, and creator tips on Raha are final and non-refundable. Fans may cancel recurring subscriptions at any time via their account dashboard; cancellation ensures the subscription will not renew at the end of the current billing cycle.

Initiating fraudulent payment disputes, unauthorized payment reversals, or bad-faith claims against Raha or Creators will result in immediate termination of the offending user’s account, permanent blacklisting of their phone number, and potential collection proceedings.

8. DMCA & Copyright Takedown Policy

Raha respects the intellectual property rights of others and adheres to the Digital Millennium Copyright Act (DMCA) and the Copyright Act of Kenya. If you believe your copyrighted work has been copied or uploaded to Raha in a manner that constitutes infringement, please submit a formal notice to our Designated Copyright Agent at dmca@rahafans.app containing:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material to be removed, including specific URLs.
• Your full legal name, physical address, telephone number, and email address.
• A statement of good-faith belief that the disputed use is unauthorized.
• A statement under penalty of perjury that the information in the notification is accurate.

9. Disclaimer of Warranties & Limitation of Liability

Raha is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. Raha does not guarantee that the service will be uninterrupted, secure, or error-free, nor does Raha endorse or assume liability for the accuracy or character of user-generated content uploaded by Creators.

To the maximum extent permitted by applicable law, Raha and its officers, directors, and employees shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of your access to or inability to use the platform.

10. Governing Law & Dispute Resolution

These Terms of Service and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the competent courts situated in Nairobi, Kenya.
